BiH House of Reps Constitutional-Law Committee: High Rep does not have constitutional authority to enact laws

The BiH House of Representatives Constitutional-Law Committee has issued an opinion stating that the High Representative does not have constitutional authority to enact laws. The BiH Constitutional Court had sought a response from the BiH House of Representatives to the request submitted by members of the Republic of Srpska National Assembly for a review of the constitutionality of Article 203a of the Criminal Code of BiH and Article 4 of the Law Amending the Criminal Code of BiH. The House of Representatives designated the Constitutional-Law Committee as the competent body to provide a response.

After deliberation, the committee concluded that “the High Representative in Bosnia and Herzegovina does not possess constitutional authority to enact laws, and that, consequently, the contested provisions of the Law Amending the Criminal Code of Bosnia and Herzegovina are unconstitutional.”
